Employment Discrimination Class Action Lawsuit Against Best Buy

Introduction

Current and former employees of Best Buy have filed a federal class action civil rights lawsuit against the multi-billion dollar national electronics chain. The lawsuit, entitled Holloway et al. v. Best Buy Co, Inc., charges Best Buy with violating federal and state laws against race and sex discrimination in employment. The suit was filed on December 8, 2005, in federal court in San Francisco, California.

Factual Allegations

The complaint alleges that Best Buy stores nationwide discriminate against women and minorities, specifically African Americans and Latinos. These employees are allegedly paid less than white males, denied promotions, assigned to less desirable positions, assigned fewer hours, and denied transfers. The suit also alleges that Best Buy discriminates against women and minorities when deciding who to hire.

The lawsuit charges that Best Buy recruits, hires and maintains a disproportionately white male sales force from which it then promotes a disproportionately white male management force. Plaintiffs' counsel allege that qualified women and minority applicants are turned away, and that even when the company does hire them, it generally does not permit them to work on the sales floor -- the pathway to promotion.

Relief Sought

The lawsuit seeks an injunction halting Best Buy's alleged discriminatory practices and the institution of company programs to ensure equal employment opportunities for women and people of color. In addition, the suit is seeking back pay and damages for all plaintiffs.
